REPORT OF IVR PRESIDENT EUGENIO BULYGIN

Since the last EC meeting in June 1999 in New York, the IVR Presidency took care of coordinating the institutional activities of the IVR.

The Presidency has cooperated with the IVR-Newsletter editor-in-chief, Prof. Ricardo A. Guibourg, and the General Secretary Prof. Pablo López Ruf, in publishing and distributing among the National Sections the IVR Newsletter Nº 24 correspondig to the period February 1999 – January 2000, which contains a report of Prof. Burton Leiser on the 19th World Congress held in New York, the announcements of future events (this meeting in Genoa, World Congresses in Amsterdam and Lund) and the news from several National Sections. The next issue of Newsletter is planned for July 2000. Fortunately the Webmaster of the former administration, Dr. Giovanni Ziccardi, kindly agreed to continue to collaborate with us as the IVR Webmaster. I wish to express my deep gratitude for his very important services.

In co-operation with the Treasury, the Presidency took care of drawing up the budget and of sending timely reminders to the National Sections concerning the payments of their fees. We have received from the former Treasury the amount of u$d 12.925,50. At the date of June 6, 2000, the IVR funds amount to u$d 11.436,04. The full analysis of the financial data of the period June 1999 – June 2000 will be given in the report of the Treasurer, Dr. Carlos E. Pettoruti.

We have been in touch with Prof. Arend Soeteman concerning the 20th World Congress to be held in Amsterdam in 2001. Prof. Soeteman will report about the organization of this event.

We have also been in touch with legal philosophers in several countries in which there is no IVR National Section. There are good perspectives for organizing new National Sections at least in Uruguay, Peru and Paraguay.

                                                                                          Eugenio Bulygin

                                                                                             (IVR President)

REPORT OF THE IVR SECRETARY GENERAL PABLO LÓPEZ RUF

During the period  June 1999 – May 2000, the Secretary General has developed the following activities:

1.     Installation of the IVR venue in Argentina:

Specially the office of the Secretary General, which counts with the appropriate and necessary building facilities for its work.

2.     Opening of an account in Argentina:

The Secretary General opened an account in the Bank Boston Ltd. for the IVR, under the name of Eugenio Bulygin, Pablo López Ruf and Carlos Pettoruti.

3.      Submission of the registration papers for the change of the IVR authorities to the Wiesbaden Court:

The IVR Secretary General had three contacts with each member of the IVR Executive Committee by sending information and asking for suggestions and recommendations.

 7.      Increasing contact with the National Sections of Central and South America:

In co-operation with the IVR President, it has been able to keep fluid contact with the Chile, Colombia, Venezuela and Mexico National Sections. Also, we could contact groups of professors in Paraguay, Peru and Uruguay in order to encourage them to create National Sections in their countries.

 8.      Gratefulness:

The Secretary General wish to thank for all the collaboration, help and support received in the transition from Prof. Enrico Pattaro, Prof. Annalisa Verza and Prof. Carla Faralli. Also I would remark that thanks to this enormous co-operation the IVR is able to use its Web-site, organized by Prof. Enrico Pattaro and his operator the Webmaster Giovanni Ziccardi.

REPORT OF THE IVR TREASURER CARLOS ENRIQUE PETTORUTI

The incoming Treasury began its work starting from November 1999, receiving from the outgoing authorities all the information about the situation of the National Sections.

Based on the reports of the outgoing Treasurer Prof. Annalisa Verza, through this short period e-mails and snail mails were sent to the National Sections in two opportunities, explaining the form in which deposit should be made, and reminding each one the fees they had to pay.

To facilitate the deposits, and while the new authorities are registered in Wiesbaden (Germany), the Treasury informed all National Sections that a special account has been opened in the Bank Boston branch Tribunales of Buenos Aires, whose holders are Eugenio Bulygin, Pablo G. López Ruf and Carlos Enrique Pettoruti. For depositing there, it is necessary to transfer the funds with a tested cable to BANKBOSTON-BOSTON (MASS-USA): ABA 011000390, credit for BANKBOSTON-BUENOS AIRES (FNBB ARBA), Account Nr: 098/3583/08.

The information about the effective numbers of the IVR National Section’s members had been taken from the previous Treasury reports.

During this short term, the Treasury received incoming funds from Italy  (IVR reserve fund transference of U$S 12.925,50 plus 395,93), USA (U$S 840,88), Japan (U$S 1.521,50), Denmark (U$S 180), Finland (U$S 241,50), Germany (U$S 1.050) and Argentina (U$S 1.140), and incoming funds for U$S 60,75. In those amounts (except Argentina), the transfer commissions are discounted.

The Romanian Association for Philosophy of Law informed about its economical problems that made it impossible to pay the fees immediately.

Eventually, it was impossible to contact the following National Sections: Bolivia, Costa Rica, El Salvador and Indonesia, because the Treasury lacks any address of them.

            To summarize:

8 National Sections have paid their dues until 1999: Argentina, Denmark, Finland, Germany, Iceland (until 2002), Japan (until 2000), Switzerland, and USA.

12 National Sections paid their dues until 1998: Australia, Austria, Bulgaria, Canada, China, Hungary, Italy, Rep. of Korea, Mexico, Spain, Sweden, and United Kingdom.

7 National Sections paid their dues until 1997: Belgium, France (Société Française pour la Philosophie), The Netherlands, Norway, Poland, Rumania, and Slovakia.

2 National Sections paid their dues until 1996: Brazil and France (Ass. Française Phil. du Droit).

3 National Sections paid their dues until 1995: Chile, Greece and New Zealand.

We have no information about payments of 12 National Sections: Bolivia, Colombia, Costa Rica, Czech Federal Republic, El Salvador, Honduras, India, Indonesia, Israel, Russia, South Africa and Venezuela.

GERMANY

NEWS

The last conference of the German Section was held in Heidelberg from Sept. 21st to 23rd 2000. It was organized by Professor Winfried Brugger and Professor Görg Haverkate from the Law Faculty of the Ruprecht-Karls-University of Heidelberg. 140 scholars of legal philosophy, among them guests from Austria, Switzerland, Italy, Japan, Taiwan, Argentina and Brazil assembled to discuss various questions under the topic of “Grenzen als Thema der Rechts- und Sozialphilosophie“. Since the german term “Grenzen“ not only connotes “border“, but also “limit“, “bounds“ and “threshold“, the 12 speakers had a great variety of methodological and ontological questions to investigate. Whereas the plenary sessions in the morning concentrated on the more general aspects of “Limits of Tolerance“ (Rainer Forst, Frankfurt), “Taboos and Violation of Taboos in Law“ (Matthias Kaufmann, Halle-Wittenberg), “Normal Case or Extreme Case as a Starting Point of Legal-Philosophical Construction?“ (Erhard Denninger, Frankfurt/M. and Josef Isensee, Bonn), the parallel sessions in the afternoon gave room to discuss the more specific themes of “Limits in Medical Law“ and “State and Social Borders“. Especially in the forum on medical law Norbert Hoerster´s (Mainz) speech on “Legal Ethics of the Protection of Life at its Beginning and at its End“ provoked not only controversial scientific discussions but also public protests outside the university compound. But also the other lectures in this group on “Limits of the Individual and Cloning“ (Ursula Wolf, Mannheim), “Limits of Patient-autonomy“ (Jochen Taupitz, Mannheim) and “Donation of Organs – at the Limits of Solidarity“ (Thomas Gutmann, Münich) did not provide simple answers and were discussed thoroughly. Of the same contemporary interest were aspects dealt with in the other parallel sessions: Udo Di Fabio (Karlsruhe/Münich), recently appointed Judge of the Federal Constitutional Court of Germany, spoke on “Displacement or Removal? On the Significance of Borders for Expanding Europe“, Massimo La Torre (Catanzaro) discussed “Limits of Citizenship: Granting Citizenship to Foreigners as a Means of Integration or as Termination of Successful Integration?“, Norbert Horn (Cologne) mused on the “Dissolution of Borders through Economical Globalization“, whereas Matthias Kettner (Essen) examined the question of “Dissolution through Worldwide Communication?“. The vivid discussions proved the significance of the topic not only in the various fields of legal theory but also in practical matters. Situated in the venerable Forum of the Old Auditorium of the University in the centre of the old city of Heidelberg, the participants found a stimulating atmosphere for conversations about central issues of present day legal philosophy.

The 7th conference of the “Junges Forum Rechtsphilosophie“ also took place in Heidelberg, Sept. 20-21, 1999. It was organized by M. Anderheiden, St. Huster and St. Kirste and dealt with “Globalization as a Problem of Justice and Governability of Law”. Nine speeches of young scholars contributed with analysis ranging from Governance and Globalization (P. Zumbansen, Frankfurt/M.), Globalization and Conceptualization (Chr. Moellers, Dresden), Problems of Internet and Law (G.-P. Calliess and Chr. Brömmelmeier, both Berlin) to Just Wars and International Justice (Th. Schramme, Mannheim; R. Kreide, Frankfurt; Th. Decker, Bielefeld) and Potential Global Conflicts (G. Dördelmann, Erfurt; G. Kreuzbauer, Salzburg).

NEWS

AMINTAPHIL held its plenary sessions in California, March 9-11, 2000, at the University of San Diego School of Law. Larry Alexander handled the local arrangements and Carol C. Gould, served as Program Chair.  Approximately 35 papers were presented on Justice and the Global Economy.

This was our first meeting in which virtually all submissions were transmitted electronically.  Discussion of the papers – via email – commenced before the conference began.

There were three paper sessions: (1) Globalization, Markets, Redistribution and Power; (2) Nations and Cultures; and Justice, Rights, and (3) Dialogue Across Cultures. A volume of the conference papers is being edited by Richard Nunan and Carol Gould.
